ОтветитьI work in a RE office here in WA state. In our office meeting this morning our designated broker announced that they are trying to pass through the legislature to get rid of dual agency here. It will be interesting if other state start following suit if it passes here!
ОтветитьEven though you have an agent through the flat fee MLS service, wholesalers still only own the contract/equitable interest and not legal title. That is, you own paper, not real estate. This means your MLS listing must clearly state what it is that you’re selling and not be misleading. For example, the MLS ad cannot state that you’re selling 123 Main St because you don’t own 123 Main St. It must state that you’re selling a contract that gives you the right to purchase 123 Main St. Also, FYI, some MLS systems don’t allow wholesalers to use them even through an agent. For example, one MLS I belong to states that the “seller” must be “The person(s) having legal ownership of the property or the person(s)' authorized agent or person(s) having the legal right to sell or lease the property, except that the owner shall not include a person(s) who merely has the right to purchase the property, but does not yet own it…..”

ОтветитьIf one of your VIP buyers wants your deal but is coming in a bit lower than what you would like but its still a healthy offer/profit should I assign it to him or try this mls strategy to get more out of it? My thing is If I take my VIP buyers offer I can have this deal wrapped up in a week... from signed contract to a $12k payday in a week... or do I risk loosing that buyer and list it on MLS in hopes to make more? I do think I could get $120k or more if it had MLS exposure

ОтветитьI use power of attorney for all my mobile home wholesales this let’s my make sure all mobile home taxes, and mobile home park lot rents are paid to transfer title and secure all documents for securing title. Works perfect because most states there’s laws against “skip titles or jump titles” which is buying selling mobile home titles without transferring ownership and paying sales tax during each transaction, and just wholesaling the title , and lot of state have rules that make you get manufactured home dealer license if hold or own too many mobile

ОтветитьJerry, the biggest question that wasn’t addressed is: How do you prepare a seller for finding out their property is on the market? Bearing in mind they most likely didn’t want to go that route in the first place. It’s one thing for a seller to sign a contract with the clauses/terms in it, but if they explicitly weren’t told the property will be listed, that could be a big bottleneck when they find out. Pls advice.

ОтветитьHey Jerry. In SC, not only do you have to have a RE license to market a property. You have to actually have a listing agreement with the owner of record.

ОтветитьAs soon as NAR learns what we are doing with brokerless, it will stop that or the Lic agent listing our property on the MLS will be terminated from NAR and and no longer be a lic agent. NAR will realize how much money they are losing allowing non lic individuals like us to list on the MLS. Like you say Jerry, be ready its coming.
