My friend is US citizen filing i130 for his father. His father tried to enter in to US with someone else’s passport in 1989. He got caught at the airport immigration in US and they gave him two options
1. Stay in US Jail or
2. Go back to his home country.
He chose to go back to his home country so they sent him back to his home country same day.
He doesn’t have any time bar!

My friend is filing i130 for him, there is a question where you have to answer about immigration proceedings,
If Beneficiary has been in immigration proceedings -and you answer yes,

Removal
Rescission
