I filed a claim for sleep Apnea by in 2009, and I was denied 6 times, I was told to show proof, I did, show proof, I sent a picture in to the VA, showing them of proof, in a sleep Clinic, I also was put in the News Paper of Scranton Times, and the Herald, and still was denied. I was told, well it is not in your Service Record. What was I supposed to do, when I was in Vietnam, do I tell the enemy, hold up, I have to report this, to be put into my Service Record File, or Log.

My VA Claims have been combined into one Single Claim although Symptoms and Evaluations are related to different Code of Federal Regulations. I have appealed requesting the separation of these symptoms back to their original claims but the VA refuses to separate them. So far no decisions have been made. Is it advisable to simply closed my claims and then resubmit one at a time to avoid the VA combining multiple claims?

Hello Christian, Michael and Maura, would you guys know why it takes the VA so long to approve my disability pay at with a wife and 1 children, it has been 4 months since i have sent them a copy of my marriage certificate and my daughter's birth certificate, any help will be appreciated.

I do not understand if I get back pay or not, my rating went up from 60% to 90% last year, so I do not know if I am entitle to back pay.

I have a question if yall still available to answer, So I have an open claim out at the moment and it looks like I’ll be increased to 94% because of it BUT , I also realized that both my knees I filed an increase for last August was increased to 20% and August 20th , 2023 is the effective date but my rating is still 10% for both knees till this day , is it possible the VA gives me back pay from that date till whenever they decide to update my rating to 20% which will bring my overall rating to 96%?

I have a TRICKY ONE FOR YOU If a widow applies for DIC and is denied for service connection but approved for survivor pension, however, her income exceeds the allowable amount for pension. Then years go by and her income is reduced and under the same claim, the VA begins to pay out a pension for years. What will happen if that widow goes on to win a service-connection claim for DIC? Will the VA pension payments get retroactively adjusted to reflect DIC payments? Will the pay go back to when the widow originally was approved for the pension or will it be when she started to receive the pension based on lower income? The original was filed within a year of the veteran's death and the initial decision took two years before she was denied service connection. Could this claim go back to the original date of death?

By the way in 04 I was rated permanent total no review employable and then they sent me a letter about 20 years ago stating that I was unemployable but I’ve been permit in total no review unemployable forever. I just want someone to tell me the truth people tell me I can get my backpay and then they tell me I can’t so I don’t know what I can do. It’s time for me to get an attorney.

What about if I filed back in 2002 for my knee.and again in 2013 They denied my claim both attempts till they actually looked at my service record granted me 10% rating last year .

I'm glad you talked about the historical tables when the VA calculates backpay. I wasn't sure if the CCK Backpay Calculator factored that in. Now I know!

I was awarded 100% and received back pay in November 2023. On January 30 2024 l received a letter stating that there were pending claim that was approved effective March 2023. Even tho I became 100% before thoes claims were approved. Will I still receive back pay for thoes pending claims.

so what if i filed a claim in 2018 for hypertension but it was denied as service connected even though my doctor filled out a medical nexus statement saying it was secondary to my sleep apnea. so in 2023 i refilled a supplemental claim with another medical nexus from my doctor and it was approved @20% with an effective date of aug2023. would that be eligible to be backdated? to 2018? i submitted both nexuses with the latest claim. but they only dated it for the aug 2023.

I have a supplemental claim that was granted. Original claim was from 2019 for osa. It was denied as well as a few other things. Kept filing supplementals after each denial and each time something else got granted back to original itf. During this process I made a separate claim for mh. It was granted in 2021. Fast forward to my last supplemental in July I got osa secondary to mh as well as to lower back and tinnitus which were from 2019. They gave an effective date of 2023 July. Do I have a case for back pay? It was continuously persued.

Question: Since my father was a Vietnam veteran and he suffered with Parkinsons for years (and he sadly passed in 2017) my 2 brothers and I were awarded the Nehmer case retroactive benefits (split 3 ways) and we are curious if that lump sum payment is considered tax-free? Do we have to include that as income and will we be required to pay taxes on it?

I applied for disability benefits back in 1969 they gave me 0 percent on one of two then later they gave me 10 or 30%and I feel that they should of gave me back pay to when I first applied

I have a question for you I am currently at 80% and have 7 claims pending Hopefully it carries me over the 💯 mark. The question is I had claims that I put in in 2017 my effective date Jan 6 and at the time I was at 40% and my claims were approved in June 2017 and I went to 80% but I never received a penny of retro pay. Now if I was going to seek legal counsel should I wait until my other claims are finalized? Thanks for your help.

How about this scenario? I had put an informal claim that I forgot about back in March 2013. I know they change the rules about informal claims in 2015, but because my initial claim was March 2013, it holds water.

I just put in to see if they would retroactively backpay me to this day, and I did give them evidence, such as my Social Security statements to show my past 26 years . What do you think about informal claims? I did not see a video about that.

I was medically retired from the Army with a 30 percent in 1985. In 2010 I switched to 30 percent with VA. A VA waiver. I was married in 1981 but I have never received any spousal pay. Can I get retroactive pay?

I was placed on the T.D.R.L. IN 1975 TO 1980 and then placed on P.D.R.L. IN 2015 I WAS RATED AT 100% P&T.FOR A T.B.I. AM I ENTITLED TO ANY BACK PAY?

I got denied for my LBP. However, the examiner did say in his notes there where in service events and treatment but no current diagnosis. Fast forward 9 years later. I have LBP, with osteoarthritis, sciatica radiculopathy and degenerate disk disease.

I just filed a supplemental claim for my new relevant evidence. I’m sure I have to go to a c&p exam.

Would anyone recommend that I mention these symptoms to the examiner? ( I know he or she can read the notes) I’m just trying to see if and when I do get percentage for me LBP. If I can use these other developments as secondaries or should I mention them ?

Any help is highly appreciated.
