Ответитьwhat if I purchase property with the intent to rehab and re-sale so I originally set the entity as an s-corp, but in the end I just decide to rent it out and keep it as a buy n hold? will it be too late in a tax filing perspective to file as a partnership?

ОтветитьIn your last example, you put rental properties (risky asset) and cash asset (safe asset) into the same LLC. In doing so, you actually put the "safe" asset, in this case cash, at risk. Am I missing something?

Ответитьtrue about depreciation - however, you don't eliminate taxes... When you sell and if you sell for more than the depreciated value, then there is something called
DEPRECIATION RECAPTURE..
so you essentiallynot paying the taxes today, and moving in to a future year.

ОтветитьSo if i have 2 llcs set up. Llc#1 partnership is 123mainllc ( for rentals) and llc#2 s corp is 456mainllc ( for flips, n wholesaling). Can i add the name of llc#2 (456mainllc) as my partnership on llc#1 ?

ОтветитьCan I ask a question, if I can take a loss of 2,000 from a 7,000$ depreciation tax cut but only made 5k in Actuallity then applying the cut to other estates. Can I keep filing tax returns on different properties to do that continously or do i only file one?

ОтветитьMy properties are in my name, if I transfer ownership to a trust and then assign interest in properties to an LLC then start paying the mortgage out of the LLC account would I then be able to deduct the mortgage payments and interest on these properties as an expense? Also what about the property taxes? Could they be deducted by the LLC as an expense even though the tax statement and the mortgage interest statement will be issued under my name at the end of the year.

ОтветитьI wish these seminars would be more forthright about depreciation, and talk about recapture. For the most part, you will have to pay back the depreciated amount (and more) at sale. So unless our plan on passing the rentals to your heirs, this is not a true benefit.

ОтветитьWouldn't one LLC to own both rentals pose a risk if one tenant sues the property's owner? The LLC has multiple rentals which can be attacked by that one suing tenant. And worse yet, the LLC has some cash.
Shouldn't each property be owned by separate LLCs?
