Terrorists (and pirates) do not fall under the Geneva convention and as such they are not held as soldiers because they do not fight on behalf of a country but conviction. Another reasin is they are not Americans or are on American soil (Gitmo is technically an international zone much like an airport) the bill of rights also do not apply to them. It is a bit like the movie 'The terminal'. Prisoners of Gitmo have no rights and the burden to prove your innocence is on you.
