ОтветитьI actually don't have an issue with the company coming at the water photoshoots from the angle of that being legitimately dangerous. Everything else feels like a culture issue, though. You're really just buying a license to that character when you get the suit.

Ответитьif you didn't know we actually had our first ever hotel-based furry convention in NZ a few weeks ago!!! it was actually such a vibe and at least personally blew my expectations out of the water, if you're interested in the community there is a tonne happening locally to check out as well as a bunch of smaller furmeets and conventions :D

ОтветитьTo be honest i am not surprised. I wouldnt buy anything from that company. They are another clue in my mind that creative people continue to get over their own noses more and more, trying to "control" the art they are making in ways that go against any human insticts. Like videogame developers saying "we have to protect the player" (no you dont, if stay in the first zone, level to max and steamroll, thats my choice alone), they go over edges that dont even have anything to do with the art. You are selling a product - after the transaction i can drag it in the mud however i see fit. Copyright and Trademarks are covered by laws, not by your ideal fantasy world on how i use your product. 95% of things in that contract would fall apart in court.

You can't say you sell things for self expression then not allow people to express thenselves in your TOS The American in me first thought was "I bought it, I'll burn it to a crisp if i want to" while that's harsh, I believe it's wrong to try to control people who have already given you the funds for the product. yes an artist made it but a company sold it to me.

ОтветитьDrama or not, there are already legal frameworks in most countries to deal with this kind of stuff, and K-Line are clearly in the fuck around part right now.
K-Line can hold the rights to their IP even after selling the suit, just like Apple keep the rights to their IP after selling you an iPhone. You can't make iPhone merch without Apple's explicit permission.
What they can not do is impose any form of ToS like this in most countries in the world. K-Line do not give access to a service. They sell a product. As a buyer, you have legal protections such as the First Sale Doctrine in the US that gives you an explicit legal right to do whatever you want with the product. Just like apple can't do anything to prevent you from opening your phone (if you try hard enough), using it on camera, or destroying it on camera.
Imagine buying a car and getting scolded publicly by the car company for getting in an accidents.

ОтветитьI feel like its only necessary to put in rules for fursuits if you are gonna be renting it temporarily, if someone buyed the suit it is THEIR suit and they can do whatever they want cause it is THEIRS, the only reason you should be adding anything similair to rules is adding a manual with how to take care of the suit and suggestions on what not to do with it.

ОтветитьAny fursuit maker who's T.O.S. restricts what you do with the fursuit including reselling it for more money is complete B.S. Same as if you buy a car, lawn mower, or a dam banana from the grocery store. Even if you sign the T.O.S. they are not enforceable. Don’t be afraid to do as you please with anything you buy, from anyone.

I totally understand what you mean by “there’s something about furry drama” like that’s literally how I got into the community in the first place. I saw really cool and unique people talking about furry drama or community history and I kept thinking about what my fursona would look like if I had one.

ОтветитьWhat K-Line is doing is extremely deceptive. They have their buyers sign a contract with these strict terms (which likely wouldn't be held up in court for various reasons), but then claim it's not legally binding and just "suggestions". By including these "suggestions" in their contract, they're implying that these terms are just as legally binding as those involving the details of the actual sale (price, transfer of goods, etc). Whether it's intentional or not, it's deceptive and pontentially illegal under UCC.
I could see this being easily fixed in two ways:
1. Remove the unenforcable terms from the contract and make it clear that these are guidelines, not requirements. This would probably be the most reasonable solution.
2. Make it clear that this is not a sale of goods, but a purchase of certain rights regarding the suit. This would let K-Line keep more control, but also makes the agreement much more complicated to enforce as they still hold title to the suit despite not having physical possesion of it. They'd have much greater responsibility to the buyer with this option.
Regardless of the intent, K-Line sbould really figure this out before it comes back to bite them. These are expensive items, so someone may well have incentive to take legal action if they have issues with the company, and I don't see these provisions surviving scrutiny in court.

ОтветитьThey’re… not renting them. They’re BUYING them, they own them now. That’s how buying something works. If you don’t want someone else to do whatever they want with an item, don’t sell it. Rent it.

ОтветитьI know this opinion is going to be unpopular, but if a consumer seeks out a vendor that is infamous for their strict TOS, they should honor the vendor's TOS. Period. Nobody is forcing them to patron this strict vendor.
A fursuit is a luxury item and consumers should do research when buying these items. If the TOS do not work for you, find a different vendor/commissioner. There's guaranteed to be another vendor with a similar quality item and less/no limitations.
However, if a carefully curated brand is what draws you to a specific vendor's product, you shouldn't be upset when that vendor wants to protect the image of their brand.
Like, if K-LINE is an artist that (despite the strict TOS) consumers admire enough to spend 5k+ on their work, why wouldn't the consumer want to protect the art in question?

ОтветитьIdk to me i wont buy something if i dont like their ToS. If you commission someone, youre agreeing to those ToS. Thats kinda on you. If someone broke my ToS id be upset too. Sure theirs is....very strict but thats just their choice. Theres tons of fursuiters out there with better ToS, that arent nearly as bad of a company.

as someone who loves creating things for people and aspires to eventually potentially make fursuits for my primary income (alongside selling art commissions) i am… shocked😭 at least this company gives me an example of what NOT to do.

ОтветитьIf I'm paying upwards of $10,000 for a fursuit, I'll jump into an active volcano with it if I want to. Don't get me wrong, I don't disagree with the fact that these people agreed to the ToS for them when they made the purchase, but it definitely still seems like a pretty large overstep to tell people what they are and aren't allowed to do with their purchase. Especially for stupid things like not mixing their suits with different costumes.

Yes their suits are adorable but it does seem like all the TOS don’t really make it worth it…
Listing "Religion" along side "criminal acts" and "anti-social expressions" is fucking wild to me. God forbid someone takes their suit to be blessed by their pastor - totally the same as using your suit to rob a bank.
