Does a Web Designer need professional indemnity Insurance?
Professional Indemnity insurance provides indemnity against legal liability and defence costs following a professional negligence claim relating to advice or services provided by your business.
As a web designer, you are not legally required to have PI cover.
However, not having it is a risk.
A single large claim can come with considerable expense.
“Surely my terms and conditions protect me?”
Yes and No!
Any tech or design business must have a strong contractual agreement with their client.
However, this will not stop a client pursuing legal action if things go wrong.
Especially if they believe that:
1) You have breached the agreement in some way
2) You made verbal or written commitments that have not been met
3) The terms were not fit for purpose and should be set aside
Strong terms and conditions do provide an excellent basis for your defence.
However, what would you do in the meantime if a client makes a claim and/or is withholding payment?
If you have no insurance in place, you would have to engage your own solicitor to form a defence.
However, this can prove costly, both in money and time.
What are the most common PI Claims?
The most frequent type of claim involves some form of contractual dispute or breach.
Our partners at Hiscox reported that in 2012, over 60% of indemnity claims for technology firms involved some form of contractual element.
Another common claim for web designers involves breach of copyright or misuse of images.
While you might make every effort to ensure that correct licensing is in place, if you are uploading images for a client or via a third party, you could still be held liable if they’re not correctly licenced.
Your role as a “Web Design Expert” means you owe a heightened duty of care to your clients.
Hosting or payment portal failures.
While you will normally have limited liability for failure of a hosting platform or payment portal, if you make recommendations for providers or platforms, you can still be held liable if the services fail and the client suffers a financial loss.
These losses can normally be defended. But not without time, effort and associated cost.
What about a Data Breach?
If sites you build link to, or obtain personal data, you could be held liable if the site owner suffers a data breach.
Costs and fines in this area can be significant and it is often a case of shooting first and asking questions later should a data loss occur.
