Hello to everyone watching. My name is Jonathan Rosenfeld. I am a member of the law firm of Rosenfeld Injury Lawyers. We have successfully litigated more than hundreds of cases of nursing home abuse. I'll explain this as we continue with this presentation.

Most Common Nursing Home Violations.

In the United States 94% of all nursing homes have been cited with violations. Most of these go unreported either because the patient is not capable of verbally expressing the nature of abuse, is fearful of repercussions from the staff or has no supporting family or friend to look after their care.

Some of the types of reported abuse include: bedsores, unexpected falls, unexplained broken bones, sprains or cuts and bruises, medications errors, malnutrition and dehydration, unsanitary conditions and untimely or unexplained death.

We treat each case individually and determine first of all if it merits going forward to trial. Some cases are settled out of court or through mediation. With trial cases we begin with the "discovery" process where we gather all of the pertinent information from the plaintiff and the defendant. In most cases we take "depositions" from potential witnesses.

Expert Witness Testimony

Here we determine our choice for the best expert witness in this case. Each expert is a specialist in his/her given field with many years of experience. This witness not only knows the medical protocol but also knows how cases of nursing home malpractice are structured.

By reviewing the contents of the case the expert witness can pinpoint exactly where the malpractice occurred and the specific deficiencies that must be addressed.

This is perhaps the key reason why we use expert witnesses. Nursing homes vary in the extent of care they provide from state to state and from one community to another. The expert witness brings this knowledge to the trial. He/she knows the "benchmark" of care required in a particular location and in a particular nursing home. To win a case the plaintiff must prove that this benchmark was violated or not followed at all. This is often referred to as the "standard of care." The expert witness will be able to determine from the nursing home's policy statement and manuals whether or not this standard of care was administered and at what level. The key here is to determine if the abuse fell below this benchmark or standard of care.

The next step is to determine who within the organization is directly or indirectly responsible for the incident (s) that took place. You have layers of administrative and staff functions and the expert witness can tell from previous experience which persons should be held accountable.

Finally, the expert witness may be called up to rebut an expert witness from the defendant. Without a strong rebuttal the defendant's expert witness testimony will stand as the standard of care for that particular nursing home.

As you can see without the use of expert witnesses winning a case for the plaintiff is virtually impossible. Without an expert witness there is no way to level the playing field as it is to be expected that the defendant's team will offer up their own expert witnesses.
