ОтветитьThe homeowners who wanted to sell their homes and who had reached out to MV Realty should have recorded their phone calls and wrote letters sent certified mail requesting that MV Realty list their house for sale and sell it as agreed in the contract. The letter should have demanded a response within 30 days as well as action taken in listing the home for sale. If MV Realty does not respond to the demand within 30 days, then the homeowner should bring a lawsuit against MV Realty for breach of contract and non-performance. In the lawsuit, the homeowner should ask the court for damages in the amount of money spent on actual or future commissions to another realtor who sold or will sell their home, and for punitive damages in the amount of $20,000 to $30,000 for emotional pain and suffering, and FINALLY, asking the court to void the contract and for a court order addressed specifically to the county recorder's office, instructing them to remove the illegal and unenforceable MV Realty lien from the homeowner's deed.
