I live in Jacksonville, Florida and I can confirm that Florida officers are absolutely horrible human beings... If you can even call them human beings, they're more like monsters.
They had absolutely no right to manhandle you the way that they did. The sheer audacity they had to say you were "Resisting Without Violence" is appalling when all you were doing was freaking out because you had no idea what was happening and why.
You can get hit with RWV even if all you're doing is crying and asking for help, its despicable.
It's just another way for them to hit their daily quota. A bullshit charge invented by police to gain additional arrests.
I sincerely hope you got the name and badge numbers of the officers involved. It would be even better if you could have gotten the name of the individual who was recording the situation so that you could obtain a copy of the video as well. Perhaps they posted it on here and you can use some keywords to find it?
I can't believe they had the audacity to Baker Act you, either. As you obviously weren't a danger to yourself or anyone around you. I feel like they honestly knew they had nothing against you so they were trying to hit you anywhere they could to "achieve the upper hand." Which is disgusting.
Being Baker Acted isn't as bad a jail, but it sure is dehumanizing. They hold up for up to 72 hours, you're stripped off all your clothes and personal belongings and are observed intently like a fish in a bowl.
I feel like you have a genuinely solid case for a lawsuit, you should try to call Morgan and Morgan. They work Pro-Bono and don't get paid unless you win.
If you didn't get the badge numbers, you can always request a copy of the report at the local sheriff's office or substation. It might cost some money, but it's worth it to have it.
In February I tried to OD and my boyfriend ended up calling an ambulance to get me help and I was transported to the nearest ER... When there, they had me on IV fluids (I believe) and monitored me through my recovery from the medication and my seizures (I have seizures regularly but the OD and extreme anxiety before the OD triggered them to be more frequent and violent)...
When I was finally coming out of the medication haze and I saw all these people around me that I didn't know, jerking me around on the bed, I freaked out, started flailing and became distraught. All I knew was I tried to kill myself and I didn't want to be saved... I wanted to be dead. In the chaos, I ended up flinging a nurse's glasses and they broke. I was transported to a mental health facility not long after and placed under a Baker Act. Spent a couple weeks there and was out in March. One night my boyfriend and I had a fight and the police got called... Immediately three cruisers showed up and three officers approached me, one said "Okay, put your hands behind your back, you're under arrest for beating up a nurse." (Their exact words) Threw me into the banister, the top half of my body was hanging off...
I instantly freaked out, I turned my head back to see the officers face who was cuffing me and asked "What do you mean beat up a nurse? I haven't beat up a nurse." They immediately started screaming at me, "STOP RESISTING! DO NOT RESIST! STOP RESISTING NOW!" I wasn't resisting at all, I was asking a question and wanted an explanation.
They then proceeded to literally drag my limp body down two flights of stairs (I live on the second floor), threw me onto the asphalt, slamming their bodies into mine (three grown men on top of all 120lbs 5'4" me), dragged me off the asphalt into the dirt and grass and was throwing me around, like a rag doll much like you described. My boyfriend heard the commotion and came out asking "Hey, is everything alright? What's going on out here?" To which the arresting officer screamed "GET THE FUCK BACK INSIDE!"
I was covered in cuts, scrapes and instant bruises. My shoulder was pouring blood, as was my forehead. The paramedics were called to patch me up, as they were doing so they asked me "What happened? You get beat up by the police?"
All the while, all three cops were standing over the top of me, all of them with this look on their faces like they were DARING me to say yes... So, I said no. Out of fear. I didn't want them to hurt me even further. I was thrown in the back of a cruiser and started seizing from all the chaos and bodily harm. The officer up front said, "I hope you're having fun back there." Instead of getting me out and laying me on my left side to ride out the seizure, or instead or calling paramedics out again.
In court, the case was basically dropped because I told the judge exactly what happened, starting from my OD in February. He took pity on me, much to the state attorney's dismay.
I had to write an apology letter to the nurse, which I didn't mind at all, as I truly felt bad for hurting hr and her glasses... And an apology letter to the arresting officer. Which I hated. It was the the fakest apology I've ever given someone in my life. This isn't the first time this same officer has given me grief and I felt like I was apologizing to Satan himself.
I wish my boyfriend has recorded the entire situation, or ANYONE had.
Because they exhibited pure police brutality that night. I am shell-shocked that these officers can get away with treating humans so cruelly. We have to do something about it because it's getting completely out of hand and dangerous.
I sincerely hope that you are able to recover, not only physically but mentally and emotionally, from this horrid experience. I hope God blesses you with peace, happiness and justice... As you didn't deserve to be put through what you went through.
My heart goes out to you and I hope you're doing better.
