I understand that you present this because of your propagandized education about it, but the truth of the matter is that McCulloch v Maryland was the final step in a SCOTUS-led coup d' etat. To understand any SCOTUS case, one has to read the decision, not the syllabus.
The case really had nothing to do with what you present, regardless of what the Court's syllabus says. The case is about granting government the right to establish an unconstitutional national bank. The founders of our Constitution discussed the idea of national banks, and rejected the idea out of fear that banks would become too powerful, and eventually take over government. The Court didn't care. It DECREED:
The 10th Amendment (that prohibits government from assuming more power than that enumerated in the constitution, such as establishing a national bank) is hereby repealed. If an amendment changes the terms of a document, the amendment is repealed, not the part of the document that the amendment intended to amend. Neither the people nor the States have a right to amend government power or tell the government what it may or may not do. (that power is reserved to the courts by virtue of Marbury v. Madison) Oaths of office are meaningless. People are not free, they are "subjects" of the government. States have no rights. Government is not constituted by the Constitution, it is constituted by its own laws.
Government shall have EVERY power unless “expressly” prohibited by the Constitution; but even when a power is expressly prohibited, government may none-the-less retain that power through implied, necessary, and “incidental” powers, given the “expressed” understanding that the absence of a grant of power means the power is granted, implied means enumerated, necessary means useful, and prohibited means permitted, because words are “magic”, and “he would be charged with insanity” who would think otherwise.
Do understand that the Constitutional Convention REJECTED the notion of Judicial Review, finding it too dangerous and an anathema to democracy. The Courts were REQUIRED to support the WRITTEN Constitution. The court gave itself the power to be - not only the head of state, but also the MORAL voice of the nation, instantly turning itself into a joint recreation of King George, who was head of state and head of the Church of England. It now does all that King George did to inspire our revolution. We fought a war to get out from under the King's judicial review.
Anyone who has researched the history of the court would come away heartbroken (at the very least). For as long as the people are kept ignorant of what actually happened (by virtue of indoctrination being called education), there is no escape. Real education is the only way out of our current predicament. Our children''s lives depend on it.
