Merits of the case aside, regarding the lease etc., what I don't understand is the assumption that in the new lease they are now letting a Data Centre and not a building?

Originally it was just a building, and the clients, first Xerox, and then Didata made it a Data Centre.

At the most the rent should only have been for market related BUILDING? Not a Datacentre, surely?
