Many independent producers ask me how much it will cost to hire a production attorney – with most expecting that they can’t afford to do so.
As I discussed in a prior video, producers MUST hire a production attorney if they hope to ever to sell their project.
But how much a production attorney costs is a bit of a trick question because production legal should be a part of every production budget and the only question is what percentage of that budget.
Typically, production legal will be 1% to 3% of a budget, so production legal on a $5 million dollar film could be from 50 to 150 thousand dollars.
But obviously there’s huge difference in dollars between 1 and 3 percent, so what determines the percentage?
Ultimately the cost of production legal is dependent on the nature of each production, such as the complexity of the project, the number of people involved, and whether or not you are shooting in the middle of a pandemic, for example.
When approaching a production attorney, the fixed percentage for production legal is very much negotiable between the producers and the production attorney.
Most of the films that I’ve been associated with paid around 1 to 1 and a half percent of the budget with a clear delineation of the legal work required.
